We do not know much about their personal mistake, but as American tax professionals dealing with worldwide US Personal taxes for American ex-pats, we hear it all the time that US Citizens who are legally married lie to the IRS on their 1040 Federal and State tax returns forms their filing status as “SINGLE” even if they are “MARRIED”, Well the lie on 1040 was not intentionally done but most of the time this would have been done just in the rush to file their tax return electronically because all the US Tax Software commonly does not allow E-filing service if the spouse does not have an SSN or ITIN


What is the correct law, If you are a US Citizen/Resident Alien legally married as of 31st Dec 2022 to a foreign national (i.e., any country other passport holders who are not born in the USA or hold an SSN) whom you need to apply for Individual Tax Identification Number often called as TIN or ITIN.

  4. Please ensure the 1040 Federal tax return is signed by both taxpayer and spouse on 1040 Page 2, It’s important to ensure there is a wet signature as electronic e-signature on a 1040 tax return is not acceptable when ITIN application is in process.

  5. If you filing for the first year you can also include the 6013(g) election statement to the 1040 tax return.
